UPDATE: Second Circuit Schedules Oral Argument on Bird Hazard Case

The U.S. Court of Appeals for the Second Circuit has scheduled Oral Argument for 10:00 a.m. on January 4, 2012, in the case of Paskar and Friends of LaGuardia Airport v. Dept. of Transportation et al. in the Ceremonial Courtroom on the 9th Floor of the Daniel Patrick Moynihan U.S. Courthouse, 500 Pearl Street, New York, New York 10007.

Mr. Paskar filed a Petition for Review of the FAA’s decision to allow the construction of a huge solid waste transfer station less than a 1/2 mile from the end of LaGuardia’s Runway 31.  The transfer station, Paskar argues, will be a magnet for hazardous bird activity and raises significant safety concerns for departing and arriving flights.  The Oral Argument will be in front of a panel of three judges, who will then issue their decision in the coming months.
